DEFINITIONS

In these Terms and Conditions of Sale, "Seller" Hostess and Cook "Buyer" means the person in his or her personal capacity or capacity as appointed by the company, or corporation by whom the order is given.

Terms of Acceptance.

If Seller accepts Buyer’s order or offer, it does so provided Buyer agree only to the terms and conditions of this Agreement, all of which are accepted by Buyer; and this Agreement supersedes Buyer’s order form, if any; and supersedes and cancels all prior communications between the parties. This Agreement shall become a binding contract either when signed and delivered by Buyer to Seller and accepted in writing contemporaneously with the order by Seller, or at Seller’s option, when Buyer shall have given to Seller specifications, delivery dates, shipping instructions or instructions to bill and hold as to all or any part of the Goods herein described, or when Buyer has received delivery of the whole or in any part thereof, or when Buyer has otherwise assented to this Agreement.

Limited Warranties and Disclaimers.

Seller represents and warrants the Goods shall be free of rot, rust, electrolytic corrosion and defects in material and workmanship for limited warranty period of 3 (three) months after delivery or as otherwise provided for in Seller’s product literature for the particular Goods in question, which literature is made a part hereof. Seller’s complete responsibility for its warranty is limited to the furnishing of sufficient goods to replace defective Goods.

Examination of Goods.

Buyer shall make an examination as to quantity of any Goods delivered hereunder immediately upon receipt and failure of Buyer to give notice of any claims within 30 days after receipt of such Goods shall be an unqualified acceptance of such Goods and a waiver of Buyer of all claims with respect thereto. No claim of any kind, whether as to Goods delivered or for non-delivery of Goods, shall be greater in amount than the purchase price of the Goods in respect of which such claim is made.

Defective or Non-conforming Goods.

If any Goods are defective or does not otherwise conform, Buyer shall give Seller written notice on the email provided on a website, of such defect or nonconformity and reasonably opportunity to cure, which opportunity shall be a minimum of 30 days after written notice of defect or non-conformity has been received by Seller.

Placing Your Order.

You may place an Order on the Hostess and Cook website and we will issue you with an Order Number and you will receive email/ sms confirming your order and after payment has been made we will confirm same.

Payment Methods And Processing.

Hostess and Cook currently accept PayPal, Visa and MasterCard. Order processing will not begin until we receive all the information we need.

Orders placed on a weekend or a Public holiday will not begin order processing until the next business day. If payment is not received within 7 days from the date that you receive your Order Confirmation, Hostess and Cook reserve the right to cancel the transaction.

Delivery of Your Products.

Delivery time takes up to 7 working days from the date your payment is receive and you shall receive notification that your delivery is available for your collection from The Courier Guy and DHL, for both National and International orders.

Delivery Options.

Your goods will be delivered for the shipping charge calculated upon entry of your postcode during the checkout process. All transit loss is at your own risk.

We want your Goods to arrive quickly and at the best shipping rate we can offer. Shipping charges are calculated based on product size and the geographical region of the delivery address.

Supply of Your Products

Subject to these Terms and Conditions, we will supply to you the Goods indicated on your Order Confirmation. When your Order items have been dispatched, we will email you to confirm shipment.

Guarantees.

Consumer guarantees apply under Consumer Protection Laws of South Africa.

Credit/Debit/ Paypal Card Fraud.

Hostess and Cook will not be responsible for any damages, (whether director indirect) suffered by a customer whose credit/ debit Pay pal card is fraudulently used or is used in an unauthorized manner.

Refunds.

Goods may be exchanged or refunded within 7 days. Should you cancel your order delivery a refund will only be considered, if goods are in original condition. Delivery charges will unfortunately not be refunded and a collection fee will be applicable. If there is an error on our part regarding the goods specification or if the good is found to be faulty, Hostess and Cook will rectify the fault. Hostess and Cook will at their discretion collect and refund goods that are unsuitable In terms of style or size however a 10% handling fee will be applicable.

Force Majeure.

To the extent permitted by law, Hostess and Cook is not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Hostess and Cook, and Hostess and Cook shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law.

These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa sand shall be subject to the non-exclusive jurisdiction of the courts of South Africa.
